Appellants were convicted for murder after a trial by jury. It was established that the appellants were complete strangers to each other and were arrested at different districts at the same time. The prosecution witnesses gave contradictory testimony as to the two arrests and as to identification.
The trial Judge drew the attention of the jury to the contradictions, nevertheless, the jury convicted the appellants.
Appellants appealed.
